Welcome to the VisionDirect Hall of Frame program created by the SmartBuyGlasses Optical Group. By viewing, applying, or participating in the program, you agree to follow and abide by the terms and conditions which may be updated at from time to time.
How do I upload photos to the HALL OF FRAME?
There are 2 easy ways to upload your photos for possible selection to the Hall of Frame:
Either upload directly via Instagram by using the hashtags #HALLOFFRAMESVD or #VisionDirectAU alongside your photo; or send your photo and/or review to the email hello@visiondirect.com.au. We’re able to find the photos by searching for the hashtags so make sure your profile is public so we can find them!
How will my photo and any other details submitted by me be used?
By sending us your photo you acknowledge that it may be selected to be displayed in the Hall of Frame page on the websites, that it may also appear on the product pages on the website if you tag a particular product, may be seen worldwide and may be used as further described below. We will select photos at its absolute discretion. For the avoidance of doubt, SmartBuyGlasses Optical Group is under no obligation to use all photos submitted.
By uploading your photo you retain your rights in that photo. By submitting a photo you hereby grant to SmartBuyGlasses Optical Group a perpetual irrevocable, worldwide, non-exclusive, royalty-free licence (with the right to sub-licence) to use, edit, alter, reproduce, translate, publish and/or distribute the photos and/or incorporate it in other works on the SmartBuyGlasses Optical Group websites or in other products or services available through the websites (the websites and the products and services collectively referred to as the “Services”) using any and all media or distribution methods (now known or later developed). You understand that this licence means your photo may be made available by SmartBuyGlasses Optical Group worldwide on the services and that other users of the services (individuals and companies) can also share and make your photos available on social media platforms or other services. If you do not want to grant the permissions set out above then please do not submit or share your photos.
By submitting your photos you are warranting that you have the right to grant the licence described above. In particular, you promise that you have obtained the permission of all the people featured in the photo (and, if they are under 18 their parents and guardians as well) to allow SmartBuyGlasses Optical Group and other users of the services to use the photos. To the extent permitted by law, you also agree to waive your moral rights in relation to any photos submitted.
Depending on how you submit your photos to the Hall of Frame, it may provide you with the ability to interact with social media services. These features may enable integration and/or access to your social media services, your profiles on those services or establish rules about how your personal information on those services will be used. You and the social media providers are in control of those issues, not SmartBuyGlasses Optical Group. You are encouraged to read all policies and information on the applicable social media services to learn more about how they handle your information before using any such features. We are not responsible for any acts or omissions by any social media service provider or your use of features that come from their platform.
What shouldn’t I upload to the Hall of Frame?
The SmartBuyGlasses Optical Group team moderates all photos before they are submitted to the Hall of Frame but to help our moderators please keep in mind the following:
Copyrighted/trade marked material: please don’t upload any photos or other content that infringes or might infringe the rights (e.g. copyright or trade marks) of a third party (such as content that contains any third party content like, trade marks, logos, insignia, photographs or art work/graphics).
Bullying: The gallery is about having fun and showing our customers best trends and looks... Let's keep anything that's harmful, threatening or violent, harassing, abusive, offensive, hateful, inflammatory, discriminatory, profane or considered to be bullying OUT.
Impersonation: Please keep any account usernames used to upload photos clean and don't impersonate anyone.
Private and confidential material: Don't post anything that would be considered confidential or private or anything that you wouldn't be comfortable with a complete stranger seeing (like work info, credit card numbers or home addresses or any intimate photos/videos or photos/videos taken without the subject’s consent).
Graphic Content: Don’t post any obscene, indecent or sexually explicit Photos or other content.
Advertising: Please don’t advertise or promote third parties’ or your own goods or services in any photos or submissions.
What happens if I have a complaint about a Photo or want my Photo removed?
If you believe a photo on the Hall of Frame is inappropriate, offensive or is violating someone’s legal rights (for example, copyright or trademark infringement) then you can report the photo by sending an email to hello@visiondirect.com.au. Once an email report is received, we will remove the photo in question whilst they investigate further.
Please note that whilst SmartBuyGlasses Optical Group can remove photos from: the Hall of Frame, the websites, services or any other website under reasonable control, we are not able, nor are responsible for, the removal of photos shared or posted by third parties on third party sites (including but not limited to social media sites) which are not under our control. If you wish to report a photo shared on a third party site, you should contact the third party or third party site directly.
We will remove any photos and/or content that may put SmartBuyGlasses Optical Group or our agents at legal risk, such as potentially libellous or defamatory comments, or photos posted in potential breach of copyright or other third party rights. The SmartBuyGlasses Optical Group or its agents reserve the right, in their sole discretion, to remove any photos or comments at any time without specifying the reason(s) for doing so or without entering into further correspondence.
